A notary is a person who is authorized by the state to carry out independent professional notarial activity, in particular to certify rights and facts of legal significance, and to perform other notarial acts prescribed by law in order to impart them to legal authenticity.
A notary is obliged: to perform his/her professional duties in accordance with the Law of Ukraine on Notary and the oath taken, to comply with the Rules of Professional Ethics of Notaries of Ukraine; to assist individuals and legal entities in exercising their rights and protecting their legitimate interests, to clarify their rights and obligations, to warn about the consequences of notarial acts so that legal ignorance cannot be used to their detriment; to keep information received by a notary in connection with the performance of notarial acts in secret; to perform other duties set out by law.
Notarial acts are performed in a premise that are a notary’s workplace. In some cases, if a person is unable to appear in the above premise, as well as if specifics of a notarial act required otherwise, notarial acts may be performed outside the specified premise.
authenticating transactions (agreements, last wills and testaments, powers of attorney, requests for notarization of transactions, etc.);
taking measures to protect inherited property;
issuing certificates of the right to inheritance;
issuing certificates of ownership of a share in the joint property of spouses (a former spouse) by virtue of a joint application or in the event of death of one of a spouse;
issuing certificates of acquisition of property from public biddings (auctions);
issuing certificates of acquisition of property from public biddings (auctions), if public biddings (auctions) were not carried out;
making an inventory of the property of a person who has been declared missing or whose whereabouts are unknown;
issuing duplicates of notarial documents stored in a notary's files;
imposing and lifting a ban on alienation of immovable property (property rights to immovable property) subject to state registration;
imposing a ban on alienation of sums of money that will be credited by an applicant’s claims established by the Law of Ukraine on Joint Stock Companies into an account of conditional storage (escrow), opened in accordance with the said Law;
certifying copies (photocopies) of documents and extracts from them;
certifying the authenticity of a signature on documents;
certifying accuracy of translation of documents from one language to another;
certifying the fact that an individual or legal entity is an executor of a last will and testament;
authenticating the fact that an individual is alive;
authenticating the fact of stay of an individual in a certain place;
authenticating the time of providing documents;
transferring statements of individuals and legal entities to other individuals and legal entities;
accepting on deposit of sums of money and securities;
performing executive inscriptions;
performing promissory note protest;
performing sea protests;
accepting documents for storage;
performing other notarial acts in accordance with law.
